A driver who police say struck pedestrians who were peacefully protesting in downtown Cedar Rapids has been charged with two criminal offenses.

According to a press release, David Alan Huston, 53, was charged with assault by use or display of a dangerous weapon (vehicle) and leaving the scene of a personal injury accident.

The press release noted that protesters were crossing Second Street SE near the federal courthouse during a peaceful protest on June 24, 2022, when Huston appeared to aggressively approach the pedestrians with his vehicle.

Huston had a green light, but other drivers waited for the protesters to cross the street, the release noted.

“There is no evidence known to us that this was in any way politically motivated nor is there any evidence that the protestors were aggressive in any way towards any members of the public,” the release states.

The Black Hawk County Attorney’s Office will be prosecuting the case. While the press release does not indicate the reason, it is likely due to a conflict, as a member of the Linn County Attorney’s Office attended the demonstration.
